"  Definitions

1.1        "Trade Broker" - Any registered member of bidorbuy.co.za who is selling any item(s) on behalf any third party.

1.2        "Client" - Any individual, company, close corporation or any other legal entity, whether it is a registered member of bidorbuy.co.za or not, who is using the services of a Trade Broker to sell good on his/her/its behalf on bidorbuy.co.za.

1.3        "Trade Brokers Directory" - a list of Trade Brokers their names and contact details as displayed and updated from time to time on the bidorbuy.co.za website.

"  As a Client using the services of a Trade Broker you agree to abide by the Terms and Conditions listed below:

2.1        All bidorbuy's standard terms and condition as listed and updated from time to time on the bidorbuy.co.za website apply to the Client as well as the Trade Broker.

2.2        All issues related to the listing of the items offered for sale on bidorbuy.co.za by the Trade Broker on behalf of the Client must be agreed in advance between the Client and the Trade Broker, including but not limiting to:

"        Starting price of the auctions or buy now price.

"        The Bid increment.

"        Duration of the auction or buy now.

"        Reserve Price, if applicable.

"        Shipping cost and arrangement.

"        Type of item (e.g 'English Auction', 'Buy Now')

"        Who would pay the bidorbuy fees.

"        What happens if the item is not sold.

2.3        The fee payable to the Trade Broker for his services must be agreed upon in advance between the Trade Broker and the Client. This fee may vary from one item to another, but bidorbuy will not intervene with regards to this issue.

2.4        The Client understands that the Trade Broker is an independent entity providing services in his own capacity and is not an employee, agents or authorised representatives of bidorbuy (Pty) Ltd.

2.5        Payment of the bidorbuy fee(s) is the sole responsibility of the Trade Broker and not the Client's or any other third party.

2.6        bidorbuy shall not intervene in any way in the relationship between the Trade Broker and the Client. bidorbuy's only role in the relationship between the Trade Broker and the Client is providing a Trade Brokers Directory on the bidorbuy.co.za website.

2.7        Unless otherwise agreed between the Client and the Trade Broker, it is the Trade Broker's onus to fulfil all aspects of the deal with regards to items sold on bidorbuy.co.za as if these items were his own. This will include but will not be limited to: o contacting the buyer after the end date of the auction or buy now. o arrange shipment of the goods to the buyer. o collect the money due for the item sold o pay the Client his portion of the money collected for the item sold on his behalf o pay the bidorbuy fees on time.

2.8        The Client and the Trade Broker are jointly and severally responsible to ensure that the items offered for sale on bidorbuy.co.za are in compliance with the laws of the Republic of South Africa, that they are legally able to be offered such items for sale and that the sale of such items are not in contravention of any law.

2.9        In no event shall bidorbuy (Pty) Ltd be liable and the Client hereby indemnifies bidorbuy (Pty) Ltd, its directors, employees and agents against any direct, indirect, incidental, special, punitive, or consequential damages, or damages for loss of profits, revenue, data or use, incurred by the Client or any third party related to the Trade Broker, arising from the relationship between bidorbuy (Pty) Ltd and the Trade Broker.
